Brief on the ODPC registration process and independence of data protection authorities

KICTANet’s submission aims to provide technical guidance on the application of data protection regulations as outlined in the Data Protection Act of 2019. It also seeks to explain the relationship between data protection regulation and emerging technology. The goal is to enhance understanding and guide the development of further knowledge as Kenya continues to build its capacity for technology regulation. The memorandum specifically addresses two topics:

1. The registration of Data Controllers and Processors, including the legal differentiation with compliance.
2. The independence of data protection authorities.
